The parties agree that, to the extent a court proceeding is permitted under these Terms, the applicable courts located in Dallas County, Texas shall constitute the agreed venue, subject to applicable law.

14. Binding Arbitration

To the maximum extent permitted by applicable law, any dispute arising out of or relating to your use of the Website or these Terms & Conditions shall be resolved by final and binding arbitration rather than in court. Arbitration shall be conducted in Dallas County, Texas, before one neutral arbitrator, in accordance with applicable arbitration rules and the Federal Arbitration Act and/or Texas law, as applicable. You and The Ultimate Matchmaker℠ waive any right to a jury trial or class, collective, or representative action to the maximum extent permitted by law. Either party may seek temporary or emergency injunctive relief from a court of competent jurisdiction where permitted by law.

Before initiating arbitration, the party seeking arbitration shall provide the other party with written notice describing the nature of the dispute and the relief requested. Notice to The Ultimate Matchmaker℠ shall be sent to 8333 Douglas Avenue, Dallas, TX 75225, or by email to info@theultimatematchmaker.com. The parties shall make a good-faith effort to resolve the dispute informally for at least thirty (30) days after receipt of the written notice before commencing arbitration, unless applicable law permits or requires an earlier proceeding.

This arbitration provision shall survive termination of these Terms.

By accessing or using the Website, you acknowledge that you have read, understood, and agree to these Terms of Use to the extent permitted by applicable law.
